Service terms and conditions

As a user of this service, you understand that all information, data, text, software, music, sound, photographs, graphics, video, messages or other materials ("Content"), transmitted over the Service, are the sole responsibility of the person from which such Content originated. This means that you are entirely responsible for all Content that you send, post, email, transmit or otherwise make available via the Service. Fervorhost.com does not control the Content posted via the Service and, as such, does not guarantee the accuracy, integrity, quality or appropriateness of such Content for any particular viewer.

You agree to not use the Service to: Send, post, email, transmit or otherwise make available any Content that is unlawful, harmful, threatening, abusive, harassing, tortuous, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically or otherwise objectionable;

Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity;

Forge headers or otherwise manipulate identifiers in order to disguise the origin of any Content transmitted through the Service;

Send, post, email, transmit or otherwise make available any Content that you do not have a right to make available under any law or under contractual or fiduciary relationships (such as inside information, proprietary and confidential information learned or disclosed as part of employment relationships or under nondisclosure agreements);

Send, post, email, transmit or otherwise make available any Content that infringes any patent, trademark, trade secret, copyright or other proprietary rights ("Rights") of any party;

Send, post, email, transmit or otherwise make available any unsolicited or unauthorized advertising, promotional materials, "junk mail," "spam," "chain letters," "pyramid schemes," or any other form of unauthorized solicitation, or otherwise violate our policy.

Send, post, email, transmit or otherwise make available any material that contains software viruses, worms or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment;

Interfere with or disrupt the Service or servers or networks connected to the Service, or disobey any requirements, procedures, policies or regulations of networks connected to the Service;

Intentionally or unintentionally violate any applicable local, provincial, national or international law, including, but not limited to, regulations promulgated by any applicable securities commission or exchange, and any regulations having the force of law; or "stalk" or otherwise harass another.

Fervorhost.com shall have the right (but not the obligation) in their sole discretion to refuse or move any content that is available via the service. Without limiting the foregoing, fervorhost.com shall have the right to remove any Content that violates the Terms of Service or is otherwise objectionable. You agree that you must evaluate, and bear all risks associated with, the use of any Content, including any reliance on the accuracy, completeness, or usefulness of such Content. In this regard, you acknowledge that you may not rely on any Content created by the fervorhost.com or submitted to fervorhost.com

You acknowledge and agree that fervorhost.com may preserve Content and may also disclose content if required to do so by law or in the good faith belief that such preservation or disclosure is reasonably necessary to: (a) comply with legal process; (b) enforce the TOS; (c) respond to claims that any Content violates the rights of third-parties; or (d) protect the rights, property, or personal safety of fervorhost.com, its users and the public.

You understand that the technical processing and transmission of the service, including your content, may involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices.

Recognizing the global nature of the Internet, you agree to comply with all local rules regarding online conduct and acceptable content. Specifically, you agree to comply with all applicable laws regarding the transmission of technical data exported from the country in which you reside.

Full payment is required before any hosting service is rendered, which includes renewals. Payment is due each 30 days following the date the account was established and or renewed. Accounts are not automatically charged and must manually paid via the signup login page. You may cancel at anytime. As a policy, we do not offer credits or refunds for hosting time already expended.

This only applies to cancellation by the client. If cancellation is done by Fervorhost.com due to restrictions violation, there will be no refund. Fervorhost.com will only allow for the discount if cancellation is not the fault of the client, as determined by Fervorhost.com All monetary transactions are in Canadian dollars. Additional features can be added at any time. Monthly feature prices are not prorated. Fervorhost.com reserves the right to change prices at any time.

Fervorhost.com is committed to a zero-tolerance, anti-Spam ming policy. Under this policy, we prohibit Spam, or any unsolicited commercial email, from being sent either: Over the Fervorhost.com network, by customers or any other users of the Fervorhost.com network (including customers' customers); AND/OR over ANY network- if the message sent advertises or mentions a site hosted on the Fervorhost.com server. We react quickly and seriously to violations, and we further reserve the right to terminate the services, without prior notice, of any customer disregarding this policy. Sending unsolicited commercial email (a.k.a. "spam"), cross-posting messages to a large number of Usenet groups, posting obscene or threatening messages while using or referring to a Fervorhost.com email address or web site URL is prohibited. The use of Fervorhost.com servers as a mail drop for responses to activities described above is also prohibited.

Backups

It is the client's responsibility to maintain local copies of their web content any information. The "Backup Manager" is included in each hosting plan and client can use this tool to back up their files.

All services provided by fervorhost.com may be used for lawful purposes only. Transmission, storage, or presentation of any information, data or material in violation of any United States Federal, State or City law is prohibited. This includes, but is not limited to: copyrighted material, trademark, intellectual property, material we judge to be threatening or obscene, or material protected by trade secret and other statute without proper authorization. The subscriber agrees to indemnify and hold harmless fervorhost.com from any claims resulting from the use of the service which damages the subscriber or any other party.

Pornography is prohibited on Fervorhost.com servers. This includes sites that may infer sexual content, or links to adult content elsewhere. Fervorhost.com will be the sole arbiter in determining violations of this provision. Also prohibited are sites that promote any illegal activity or present content that may be damaging to fervorhost.com servers or any other server on the internet. Links to such materials are also prohibited.

Fervorhost.com does not host sites of its competitors or web pages promoting sites of its competitors.

Any illegal activity, including adult content, links to adult content web sites, online gambling, spam ming or hacking will result in your site being shut down.

Fervorhost.com will be the sole arbiter as to what constitutes a violation of this provision.

Fervorhost.com enforces a strict "No SSH" policy. Any domain that uses a script which can be used to elevate privileges or enable SSH services, will be instantly suspended.

Each account comes with its own cgi-bin You are free to use any CGI scripts you wish, [as long as they are not on our banned script's list] however we reserve the right to disable any CGI script that affects normal server operation or service to other Fervorhost.com customers. You will be notified in 24 hours about offending CGI script.

Fervorhost.com is not responsible for scripts that you use in your hosting. It is not our responsibility to ensure your scripts function. Please don't expect our support tech's to troubleshoot aspects of your scripts or third party scripts that you use on your sites hosted on our servers.

Changes to this Statement

Fervorhost.com reserves the right to change this Policy any time, so please, check this page at least once a month or when in doubt. Fervorhost.com strives to provide the best possible service to all our customers, but we will not tolerate any unlawful activity or abuse on our servers. We respect freedom of speech and expression unless it is harmful to others. These brief guidelines are imposed to protect you, other Fervorhost.com customers and us against such harm.
